PERSONAL DATA PROTECTION NOTICE

This Personal Data Notice (“Notice”) describes how Events Wizard/ Elysium Sdn Bhd (a company incorporated under the laws of Malaysia with its place of business at 7 Jln 3/115A Tmn Pagar Ruyong 58200 Kuala Lumpur (“EW”) uses your Personal Data.

By engaging EW to provide services or by interacting with EW either at our events, conferences, fairs, seminars or otherwise, or by using EW’s website at www.eventswizard.net/ www.elysiumweddings.net (“Website”) or by using our Facebook page at www.facebook.com/eventswizard  www.facebook.com/elysiumweddings, you consent to the processing of your Personal Data by EW and all persons involved in the provision of services by EW.

In the event of any conflict between the English and other language versions, the English version shall prevail. EW shall have the right to modify, update or amend the terms of this Notice at any time by placing the updated Notice on the Website. By continuing to communicate with EW or by continuing to use EW’s services following the modifications, updates or amendments to this Notice shall signify your acceptance of such modifications, updates or amendments.

Collection of Personal Data

Personal Data means information about you which you have provided to EW, such as your name, address, telephone number, NRIC, email address, your personal preferences, wedding or event details/ particulars, particulars of your spouse or family members or friends and/or colleagues or third party service providers and bank account information, IP addresses, photographs and images and any information which may identify you, your spouse or family members, friends and/or colleagues that has been or may be collected, stored, used and processed by EW from time to time

In addition to the Personal Data you provide to EW directly (i.e. during your communications with EW and/or when you engage EW to provide services or otherwise), EW may also collect your Personal Data from a variety of sources, including without limitation at any events, conferences, fairs, seminars or otherwise, organised or sponsored by EW and/or from the cookies used on the Website and/or from EW’s Facebook page.

The provision of your Personal Data is voluntary. However, if you do not provide your Personal Data, EW may not be able to (i) communicate with you; (ii) provide you the services you require or (ii) access certain sections of the Website where log in is required.

We use cookies on our Website to track website visitorship and experience. Most web browsers are designed to accept cookies. If you do not wish to receive any cookies, you may set your browser to refuse it.

Purposes of Processing

EW may use and process your Personal Data for the purposes relating to the services you have requested and for the business activities of EW which shall include, without limitation:-

• (a) to communicate with you and/or such individuals as may be required for the purposes relating to the services you have requested;
• (b) to respond to questions and comments from you;
• (c) for internal administrative purposes;
• (d) to provide information to regulatory and governmental authorities in order to comply with statutory and government requirements;
• (e) for EW to comply with its obligations under law
• (f) in connection with any legal proceedings or prospective legal proceedings; and
• (g) to establish, exercise or defend EW’s legal rights,

and you agree and consent to EW using and processing your Personal Data in the manner as identified in this Notice.

Other purposes

EW may also use and process your data for other purposes such as:-

• (a) to send you materials such as newsletters, articles, write-ups as well as other updates;
• (b) to the purchaser (or prospective purchaser) of any business or asset which EW is (or is contemplating) selling;
• (c) for the purposes of disaster recovery; and
• (d) to distribute information or details of events, conferences, fairs, seminars or otherwise which may of interest to you,

by way of email or mail.

If you do not consent to EW processing your Personal Data for the purposes listed above, please notify EW in writing to the contact details stated below.

Transfer of Personal Data

As EW’s information technology storage facilities and servers may be located in other jurisdictions, your Personal Data may be transferred to, stored, used and processed in a jurisdiction other than Malaysia. Further, your personal data may be transferred out of Malaysia for the purposes as described above where such publications and journals are located outside of Malaysia. You understand and consent to the transfer of your Personal Data out of Malaysia as described herein.

Disclosure to Third Parties

EW may engage other companies, service providers or individuals to perform functions on EW’s behalf, and consequently may provide access or disclose to your Personal Data to the third parties such as those listed below (not exhaustive):

• (a) information technology (IT) service providers;
• (b) data entry service providers;
• (c) storage facility providers;
• (d) banks and financial institutions;
• (e) insurance providers;
• (f) any professional advisors and external auditors;
• (g) regulatory and governmental authorities in order to comply with statutory and government requirements.

This Notice only applies to the collection and use of Personal Data by EW. It does not cover third party sites to which we provide links, even if such sites are co-branded with our logo. EW does not share your Personal Data with third party websites. EW is not responsible for the privacy and conduct practices of these third party websites, so you should read their own privacy policies before disclosure of any Personal Data to these websites.

EW will not sell your personal information to any third party without your permission, but we cannot be responsible or held liable for the actions of third party sites which you may have linked or been directed to the Website.

Access & Correction Requests and Inquiries

In respect of your right to access and/or correct your Personal Data, EW has the right to refuse the your requests to access and/or make any correction to your Personal Data for the reasons permitted under law, such as where the expense of providing access to you is disproportionate to the risks to your privacy.

General

EW uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your Personal Data and will not knowingly allow access to this data to anyone outside EW, other than to you or as described in this Notice. However, EW cannot ensure or warrant the security of any information you transmit to EW and you do so entirely at your own risk. In particular, EW does not warrant that such information may not be accessed, altered, collected, copied, destroyed, disposed of, disclosed or modified by breach of any of EW’s physical, technical, or managerial safeguards.

Our Website does not target and is not intended to attract children under the age of 18 years old. We do not knowingly solicit personal information from children under the age of 18 years old or send them requests for personal data.

This Notice is governed by and shall be construed in accordance with the laws of Malaysia. You hereby submit to the non-exclusive jurisdiction of the Malaysian courts.

Notis Data Peribadi ini (“Notis”) menerangkan bagaimana Events Wizard/ Elysium Sdn Bhd (satu syarikat yang diperbadankan di bawah undang-undang Malaysia dengan alamat perniagaannya di 7 Jln 3/115A Tmn Pagar Ruyong 58200 Kuala Lumpur (“EW”) menggunakan Data Peribadi anda.

Dengan melantik EW untuk menyediakan perkhidmatan atau dengan berhubung dengan EW sama ada di acara kami, persidangan, pameran, seminar atau sebaliknya, atau dengan menggunakan laman web EW di www.eventswizard.net/ www.elysiumweddings.net (“Laman Web”), anda bersetuju dengan pemprosesan Data Peribadi anda oleh EW dan semua orang yang terlibat dalam penyediaan perkhidmatan oleh EW.

Jika berlaku sebarang percanggahan di antara versi Bahasa Inggeris dan versi bahasa lain, versi Bahasa Inggeris akan diguna pakai. EW berhak untuk mengubahsuai, mengemaskini atau meminda terma-terma Notis ini pada bila-bila masa dengan meletakkan Notis yang dikemaskinikan di Laman Web. Pengutipan Data Peribadi

Data Peribadi bermaksud maklumat mengenai anda yang telah diberikan oleh anda kepada EW, seperti nama, alamat, nombor telefon, No. KP, alamat e-mel, kehendak peribadi, butir-butir perkahwinan atau acara, butir-butir pasangan anda atau ahli keluarga atau rakan atau rakan sekerja atau pembekal perkhidmatan pihak ketiga dan maklumat akaun bank, alamat IP, foto and imej dan sebarang maklumat yang boleh mengenal pasti anda, pasangan anda, rakan atau rakan sekerja butir-butir ‘social media’, kehendak kandungan, butir-butir akaun bank, yang telah atau akan dikutip, disimpan, digunakan dan diproses oleh EW dari semasa ke semasa.

Sebagai tambahan kepada Data Peribadi yang anda berikan kepada EW secara langsung (iaitu semasa anda berkomunikasi dengan EW dan/atau apabila anda melantik EW untuk memberi perkhidmatan atau sebaliknya), EW juga mungkin mengutip Data Peribadi anda daripada pelbagai sumber, termasuk tetapi tidak terhad kepada sebarang acara, persidangan, pameran, seminar, atau sebaliknya yang diatur atau ditaja oleh EW dan/atau dari cookies yang digunakan di Laman Web dan/atau melalui laman Facebook EW.

Pemberian Data Peribadi anda adalah secara sukarela. Walau bagaimanapun, jika anda tidak berikan Data Peribadi anda, EW tidak mungkin dapat i) berkomunikasi dengan anda; ii) menyediakan perkhidmatan yang anda perlukan atau (iii) mengakses seksyen tertentu pada Laman Web di mana log masuk dikehendaki.

Tujuan Pemprosesan

EW boleh menggunakan dan memproses Data Peribadi anda untuk tujuan berkaitan dengan perkhidmatan yang anda minta dan untuk aktiviti-aktiviti perniagaan EW yang termasuk, tanpa had:-

• (a) untuk berkomunikasi dengan anda dan/atau individu-individu sedemikan yang diperlukan untuk bagi tujuan maksud yang berkaitan dengan perkhidmatan yang diminta oleh anda;
• (b) untuk menjawab soalan-soalan dan ulasan daripada anda;
• (c) untuk pengesahan dan tujuan pentadbiran dalaman;
• (d) untuk memberi maklumat kepada pihak berkuasa kawal selia dan kerajaan bagi mematuhi syarat-syarat di bawah undang-undang dan kerajaan;
• (e) untuk EW mematuhi obligasinya di bawah undang-undang;
• (f) yang berkaitan dengan apa-apa prosiding undang-undang atau prosiding undang-undang bakal; dan
• (g) untuk menubuhkan, menjalankan atau mempertahankan hak-hak undang-undang EW,

dan anda bersetuju dan mengizinkan EW untuk menggunakan dan memproses Data Peribadi anda menurut cara sebagaimana yang dikenalpastikan dalam Notis ini.

Tujuan lain

EW boleh juga menggunakan dan memproses data anda untuk tujuan lain seperti:-

• (a) untuk menghantar bahan-bahan kepada anda seperti surat berita, artikel, penulisan serta pengemaskinian yang lain;
• (b) bagi maksud pemulihan bencana; dan
• (c) untuk mengedarkan maklumat atau butir-butir acara, pameran, seminar, persidangan dan ceramah yang mungkin menarik minat anda,

melalui emel atau surat.

Jika anda tidak bersetuju dengan EW memproses Data Peribadi anda untuk tujuan yang disenaraikan di atas, sila maklum kepada EW secara bertulis ke butiran hubungan yang dinyatakan di bawah.

Pemindahan Data Peribadi

Oleh sebab kemudahan simpanan teknologi maklumat dan pelayan mungkin terletak dalam bidang kuasa lain, Data Peribadi anda mungkin dipindahkan, disimpan, digunakan dan diproses dalam bidang kuasa selain daripada Malaysia. Selanjutnya, Data Peribadi anda mungkin dipindahkan keluar dari Malaysia untuk tujuan sebagaimana yang diperihalkan di atas di mana penerbitan dan jurnal berada di luar Malaysia. Anda memahami dan bersetuju untuk pemindahan Data Peribadi anda keluar dari Malaysia sebagaimana yang diperihalkan di sini.

Pendedahan kepada Pihak Ketiga

EW boleh melantik syarikat-syarikat, penyedia-penyedia perkhidmatan atau individu-individu lain untuk melaksanakan fungsi bagi pihak EW, dan sebagai akibat boleh menyediakan akses atau mendedahkan Data Peribadi anda kepada pihak-pihak ketiga sebagaimana yang disenaraikan di bawah (tidak terhad):-

• (a) penyedia-penyedia perkhidmatan teknologi maklumat (IT);
• (b) penyedia-penyedia perkhidmatan kemasukan data;
• (c) penyedia-penyedia kemudahan simpanan;
• (d) bank dan institusi kewangan;
• (e) penyedia-penyedia insurans;
• (f) sebarang penasihat profesional dan juruaudit luar;
• (g) pihak berkuasa kawal selia dan kerajaan bagi mematuhi syarat-syarat di bawah undang- undang dan kerajaan.

Notis ini adalah hanya untuk kepada koleksi dan pengunaan Data Peribadi oleh EW. Ia tidak meliputi laman web pihak ketiga yang mana kami menyediakan ‘link’, walaupun laman web tersebut adalah dipasarkan bersama dengan logo kami. EW tidak akan memberi Data Peribadi anda kepada laman web pihak ketiga. EW tidak akan bertanggungjawab untuk amalan privasi dan kelakuan yang digunakan oleh laman web pihak ketiga, oleh demikian, anda patut membaca polisi privasi mereka sebelum mendedahkan Data Peribadi anda kepada laman web tersebut.

EW tidak akan menjual Data Peribadi anda kepada pihak ketiga tanpa persetujuan anda, tetapi kami tidak akan bertanggungjawab untuk tindakan laman web pihak ketiga di mana anda mungkin diarahkan kepada laman web tersebut.

Berkenaan dengan hak anda untuk mengakses dan/atau membetulkan Data Peribadi anda, EW berhak untuk menolak permohonan anda untuk mengakses dan/atau membuat sebarang pembetulan pada Data Peribadi anda atas alasan-alasan yang dibenarkan di bawah undang-undang, seperti apabila pemberian akses kepada adalah tidak seimbang dengan risiko kepada privasi anda.

Am

EW menggunakan perlindungan fizikal, pengurusan and teknikal yang berpatutan dari segi komersil untuk mengekalkan integriti dan keselamatan Data Peribadi anda dan tidak akan dengan sengaja membenarkan akses ke maklumat ini kepada sesiapa di luar EW, selain daripada anda atau seperti yang diterangkan dalam Notis ini. Walau bagaimanapun, EW tidak memastikan atau menjamin keselamatan maklumat yang anda hantar ke EW dan anda hantar maklumat tersebut pada risiko anda sendiri sepenuhnya. Khususnya, EW tidak menjamin bahawa maklumat tersebut tidak boleh diakses, dipinda, dikumpul, disalin, musnah, dijual, didedahkan atau diubahsuai dengan melanggar mana-mana perlindungan fizikal, teknikal atau pengurusan di EW.

Laman Web kami tidak mensasarkan dan tidak bertujuan untuk menarik kanak-kanak di bawah umur 18 tahun. Kami tidak akan dengan sengaja mendapatkan maklumat peribadi daripada kanak-kanak di bawah umur 18 tahun atau menghantar permintaan kepada mereka untuk data peribadi.

Notis ini adalah tertakluk oleh dan ditafsirkan mengikut undang-undang Malaysia. Anda dengan ini menyerah kepada bidang kuasa mahkamah Malaysia yang tidak eksklusif.

GENERAL TERMS & CONDITIONS

Definitions :

– “Event” means the event in which the Event Manager has been engaged by your company to plan and organize;
– “Event Date” means the date of the Event;
– “Event Manager/ Planner” means Events Wizard Sdn Bhd or buy a research paper for college order assignment Elysium Weddings Sdn Bhd;
– “Fees” means the fees agreed upon between the Event Manager and You as set out in the relevant quotation;
– “Your company / You” means the client who is engaging the Event Manager for the Event.;

Terms & Conditions :

1. Terms of Payment: Fees shall be agreed as stated in the relevant quotation. 50% of the Fees is required as deposit for the reservation of the Event Manager’s dates and prior to commencement of work (“Deposit”) and 50% of the Fees is due on the Event Date. Payment may be made by cash or cheque in favour of Events Wizard Sdn Bhd (Account No: 352093025101 HSBC). A charge of 10% of the total billing will be imposed on cheques returned for any reason. Event Manager reserves the right to charge interest at the rate of 2% per month.

2. Cancellation: Full payment of the Fees is required to be settled if the Event is cancelled within 7 working days before the Event. If a substantial part of the Event thereof does not take place or is cancelled and no substitute event is provided to the Event Manager by then, the deposit of 50% of the total billing will be forfeited.

3. Klang Valley Only: All prices quoted are based on setup within Klang Valley unless specifically identified in the quotation/ proposal, EXCLUDING the attendance at any rehearsals and subject to availability. A revision in price and/or proposal is applicable prior to confirmation and final site inspection by related party(s).

4. Failure: All the rights that are released and quoted are only given subject to payment in full. The Event Manager reserves the rights to terminate the delivery of goods and/or services in its entirety and/or partially with the possibility of a monetary claim(s) as per order value should you fail in fulfilling any of the Terms terms & Conditions conditions stated herein, inclusive of Terms of Payment.

5. Additional Fee: An additional fee will be imposed upon confirmation for last-minute venue/ceremony installation/preparation written requests. The Event Manager and your company shall negotiate in good faith with a view to agreeing upon a fair and reasonable fee.

6. Change: You shall not change the date, time and/or location of the Event (“Event Details”) as listed in the quotation/proposal without first contacting and advising the Event Manager of said change so as to determine the Event Manager’s availability. Where you change the Event Details, subject to the availability of the Event Manager, every effort will be made by Event Manager and staff to transfer location reservations, sub-contractors and support to the new date. In such event, you agree that any expenses including but not limited to deposits and fees that are non-refundable and non-transferable, are your sole responsibility. There may also be additional charges above and beyond those set forth in paragraph 1 above. The Event Manager is not responsible for these compromises in quality in the event of last minute changes. If you change the Event Details and the Event Manager is unavailable to provide services, then the Event Manager is released from all contract obligations, and shall in no way be held responsible or liable in any manner whatsoever for non-performance. You shall also forfeit the deposit paid for non-compliance with these terms and conditions.

7. Permission: You confirm that the Event Manager is given the right and permission to use any and all images, both photographic prints and digital images and videos or other recording media, in their advertising, studio, literature, event exhibitions, editorial, trade or any other purpose and in any manner and medium. You release the Event Manager and its legal representatives and assigns from all claims and liability relating to said photographs, videos or other recording media. It is agreed that the Event Manager may display and use the photographs taken for advertising, display, website and internet promotion, photographic contests, public display such as in malls, photography books, store fronts, window displays, studio display, television advertising, magazine advertising and any other purpose thought proper by the Event Manager. You acknowledge that this is for promotional purposes only and does not expect any compensation of any kind. There shall be no expiration period for this permission.

8. Co-operation: The Parties agree to positive cooperation and communication for the best possible results. The Event Manager is not responsible for the acts and omissions of key individuals or their failure to be present or to cooperate during the Event.

9. House Rules: Although all efforts to negotiate with the venue site management shall be made by the Event Manager, the Event Manager is limited by the guidelines of the venue site management. You agree to accept the results of their imposition on the Planner.

10. Loan Items: The Event Manager shall at all times retain ownership and title of any items loaned to you (“Loan Items”). All risks of loss or damage to the Loan Items from any cause will be assumed by you. The Loan Items shall be returned in the condition received from the Event Manager and the security deposit for the Loan Items as stated in the quotation/ proposal shall be refunded. Where the Loan items are damaged or lost, You shall be required to reimburse the Event Manager for the cost of the Loan Items. Failure to reimburse the Event Manager within 7 days upon receipt of the Event Manager’s invoice for the damaged and/or lost Loan Items will entitle the Event Manager to forfeit the security deposit .

11. Payments and Consents: For the avoidance of doubt, You are responsible for making the necessary payments and obtaining the relevant clearances and/or consents from the relevant authorities in respect of deposit payments; license fees payable to third parties and/or third party organizations or entities and/or any governmental or statutory licensing bodies (eg; MACP, PPM, RPM, PDRM, Municipal Council, etc.); copyright clearance and obtaining the relevant insurance coverage for the Event.

12. You are also required to make provisions for the following upon confirmation, whichever applicable;

• i. Basic amenities (ie; water & electricity) nearest to event ground.
• ii. Tentage c/w basic furniture and fittings.
• iii. Dressing room(s) & meals (for artiste & crew).
• iv. Security and barricades (for equipment & stage).
• v. Any other necessities deemed relevant and purposeful.

13. Limit of Liability: The Event Manager warrants and declares that every effort will be made to provide high quality services. You fully understand and agree that the Event Manager shall not be responsible or held liable in the event the Event Manager is prohibited from providing services due to illness, hospitalization, auto accident, transportation breakdown/disruption, traffic difficulties, acts of God such as inclement weather or other unforeseen incapacitation or other cause of non-arrival on the day of the Event. The Event Manager will make every attempt to notify you and to provide for a substitute Event Manager who can provide services if time and resources permit. In any event, the Event Manager, his agents and assigns shall NOT be held liable for any compensation or any damages (including punitive) due to non-performance of any services resulting from such incapacitations, non-arrival, errors and/or omissions of any type. In no event shall the Event Manager (and/or its related entities), officers, directors, employees, or agents, be liable to you for any damages howsoever resulting from any errors or omissions in any content or for any loss or damage or claims of any kind incurred as a result of you engaging of the Event Manager or the acts or omissions of you and/or your family, friends, guests, contractors, workmen, other vendors, suppliers), whether based on warranty, contract, tort, or any other legal theory, and whether or not the Planner is advised of the possibility of such damages. Further, the Event Manager bears no liability whatsoever for any compensation or damages for any form of injuries, disputes, damages, damages to property, indirect loss, direct loss, consequential loss or deaths as a result of the acts and/or omissions of any individuals or entities and participation and/or attendance of any individuals or entities during, before, and after the Event. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS.

14. Weather contingency: Cost of weather contingency is NOT inclusive of the quote. Similarly, when delays occur due to circumstances outside the Event Manager’s control, an additional fee for the extra time involved will be charged at the hourly rate of RM250.00.

15. Non-guarantee: Although every possible care will be taken to plan and co-ordinate the Event and vendors for the Event, the Event Manager cannot place an unconditional guarantee on the above. In the event that any vendor cancels prior to the Event, you agree that the Event Manager may substitute a new vendor with advance notice to you and any additional costs are to be paid by you.

16. Indemnity: You shall indemnify and hold the Event Manager harmless against and all actions, proceedings, demands, claims, liabilities or damages, costs or expenses whatsoever or howsoever arising as a result of: (a) any omission, breach or non-compliance by you of these terms and conditions; and (b) any act or omission by your guests for the Event and/or any individuals or entities participating in or attending the Event and any form of injuries, disputes, damages, damages to property, indirect loss, direct loss, consequential loss or deaths arising or resulting therefrom during, before, and after the said Event; including without limitation, those arising from or in connection with third party claims for breach of contract, personal injury, damage and/or loss, defamation, failure to obtain the relevant licenses, the infringement of any patent, trademark, copyright or other intellectual property rights.

17. Final Decision: The Event Manager’s role is that of an advisor and planner. You shall make the final selections of the vendors who provide the services and the Event Manager shall implement such decisions. Final decisions and instructions relating to all aspects of the Event must be made by you although the Event Manager may be required from time to time to liaise and deal with your committee members who may provide instructions and opinions relating to the Event. You understand that the Event Manager is merely the planner and organizer for the Event and you shall not hold the Event Manager responsible for the quality of the goods and services provided by such vendors and acts and/or omissions of the respective vendors.

18. All terms & conditions will be deemed to be agreed and accepted once the job is executed and shall be binding on you even if you fail to sign on the relevant quotation and/or agreement prior to the Event Date. Any dispute or changes will have to be made with signed amendments prior to the commencement of the Event.

19. The quotation issued by the Event Manager for the Event, shall be taken, read and construed as an essential part of these terms and conditions.

20. This Agreement terms and conditions are governed by and are to be construed in accordance with the laws of Malaysia and the Parties hereby irrevocably submit to the exclusive jurisdiction of the courts of Malaysia.

These terms and conditions (“Terms”) constitute a legal agreement between the Planner and you.
